Explanation of YES Vote to HB 1089: The Impeachment of Ombudsman Merceditas Gutierrez

Ang kinatawang ito, bilang isang endorser ng paghahabla kay Ombudsman Merceiditas Gutierrez, ay bumuboto ng yes sa House Resolution No. 1089.

G. Speaker, ayon sa Ulat ng Taong 2010 ng Tranparency International, sa loob ng sampung sunod-sunod na taon, ang ating bansa ay konsistenteng nagmamarka ng 3.0 sa perpektong 10 ng corruption perception index. Ito'y naglalagay sa Pilipinas sa ika-41 sa mga bansang pinakakurap sa buong mundo, ika-9 sa buong Asya at ika-4 sa buong Southeast Asia.

Graft and corruption affect the women of this country in many ways than we could imagine. Sa isang lipunan na iniiwasan ng mga mamumuhunan dahil sa talamak na kurapsyon, ang kababaihan ang siyang naging pinakabiktima ng kawalan at kakulangan ng trabaho. Tatlumpu't pitong porsyento ng ating kababaihan ang walang trabaho (unemployed) habang 7.1 M naman ang kulang sa trabaho (under-employed).

G. Speaker, the women who struggle against poverty and the women who are fighting graft and corruption in this country take no comfort nor consolation that the person which the Committee on Justice had indicted to have grossly failed in her duties as Ombudsman is a woman. Ang Marso ay buwan ng kababaihan. Nakahapag sa kapulungang ito ang mga reklamo laban sa isang babae na dapat ay panagutin sa mga kasong kung saan mas pinili niya ang maging traydor kaysa maging tapat sa paglilingkod sa bayan, sa paglilingkod sa mas maraming naghihirap na kababaihan.

Among the charges levelled at Ombudsman Merceiditas Gutierrez, from the Fertilizer Scam to the Euro Generals among so many others, this representation finds her conduct in the Mega-Pacific deal most reprehensible and most shameful.

The facts of this case are now a matter of public knowledge. In its 2004 decision on the P1.3 Mega-Pacific deal, the Supreme Court found that the respondents “recklessly” violated existing Comelec bidding rules and procedure. This was our Supreme Court speaking and here is a case where all the Ombudsman had to do was to adopt the decision of the highest tribunal of the land and specify the violations and the specific criminal liabilities of the respondents.

At taliwas sa kanyang sinumpaang tungkulin, Ms. Gutierrez took her sweet time in taking no action on the case. Dito pa lang Mr. Speaker, malinaw na ang kanyang mga ginawa at hindi ginawa ay dapat na pananagutan ni Ms. Gutierrez. Dito pa lang, malinaw na ang kanyang pag-abuso sa kapangyarihan ay maituturing na paglapastangan sa tiwala na ibinigay sa kanya ng mamamayan.

Ms. Gutierrez held herself up as a schemer and manipulator of the highest order, a schemer and manipulator who places the interest of her patrons and friends above the interests of the country and the public.

But more than this, Mr. Speaker, ang kinatawang ito'y bumuboto ng yes dahil sa matagal nang panahon, ang ating pamahalaan, ang ating burukrasya at ating bansa ay nilalamon ng graft and corruption dahil ang mga tiwali sa ating pamahalaan ay nagtatamasa ng climate of impunity dulot ng mga opisyal na katulad ni Ms. Gutierrez.

Batay sa mga konsiderasyong nailahad, Mr. Speaker, ang kinatawang ito'y bumuboto ng yes sa House Resolution No. 1089.
